U.S. Senator Tommy Tuberville’s (R-Auburn) legal team asked a Montgomery court to dismiss the latest lawsuit challenging his eligibility to run for governor, calling the effort an extension of the Doug Jones campaign.
Jordan Doufexis, Chairman of Tuberville’s campaign, said the motion follows the more than 100 pages of evidence the campaign submitted last week during the Alabama Republican Party’s formal hearing that unanimously confirmed Tuberville’s residency.
“Today Coach Tuberville’s legal team asked the court to dismiss the illegal challenge to Coach’s nomination by the Democrats,” Doufexis said. “Just last week, Coach’s team turned over more than 100 pages of written evidence proving beyond a shadow of a doubt that he is a resident citizen of Alabama and exceeds all qualifications to be the state’s next Governor.”
Doufexis tied the lawsuit to Tuberville’s general election opponent.
“Team Tuberville is moving on from this ridiculous narrative coming from a flailing Doug Jones campaign who is desperate to talk about anything other than D.C. Doug’s communist socialist policies,” he said.
The quo warranto lawsuit was filed last week in Montgomery Circuit Court.
It is the third legal challenge to Tuberville’s residency this cycle, following a Covington County suit dismissed for lack of jurisdiction and the ALGOP party challenge dismissed unanimously on June 14.
Tuberville faces Jones in the November 3 general election.
