Earlier this week, the Supreme Court issued a decision that I believe will cause chaos in our country for years to come. Last year, President Donald Trump signed an executive order halting birthright citizenship. But because we have a spineless Supreme Court, full of out-of-touch justices who are scared of their own shadows, they went against President Trump and ruled that birthright citizenship can stay.
Birthright citizenship was originally intended to be a privilege reserved for American citizens. But for decades, other countries have exploited birthright citizenship.
For example, pregnant foreign women routinely fly to the U.S. to give birth so their children can claim American citizenship. Over the last 15 years, it’s possible that as many as 1.5 million children were born in the U.S. through this practice known as “birth tourism.”
During the Biden administration, it was common for pregnant illegal alien women to cross the southern border and show up at American hospitals to give birth, claiming citizenship for their children and paying nothing for the care and treatment provided. The Chinese are also known for doing this in the U.S. territory of the Northern Mariana Islands.
In fact, this loophole has been exploited so much that foreign countries have entire birth tourism industries dedicated to creating fake documents for their citizens to fly to the U.S. to give birth.
Birthright citizenship originates from the 14th Amendment, which was introduced in 1866 by Senator Jacob Howard to address the integration of newly freed slaves into American society following the Civil War. That was absolutely the right thing to do. But it has nothing to do with the issues of birth tourism that we are talking about today. Thanks to Joe Biden, we now have tens of millions of people living here illegally. Some of these illegals are violent criminals, rapists, and terrorists.
But all of them are driving up costs, shorting our housing supply, and taking jobs that would otherwise go to Americans.
The six justices who voted for this are clearly out-of-touch with the realities American families are facing. I don’t know if it’s because they hail from Ivy League schools and run in elitist circles or because they have private security protecting them 24-7, but they clearly aren’t hearing from parents who are concerned about their child’s safety at school or families who are having a hard time making ends meet because of rising housing costs.
The illegal immigrants who are living among us don’t exist in a vacuum—they are mooching off American taxpayers, filling up our hospitals, crowding our classrooms, and taking over our cities—all while not even bothering to learn our language. We should be focused on mass deporting these people.
But the gutless Supreme Court apparently thinks the rights of these illegals outweigh those of American citizens. Ever since the 2021 Supreme Court decision overturning Roe v. Wade, the Supreme Court justices have given into the fear and intimidation tactics from the lunatic base of the Democrat-Communist Party and are now compromised. They should remember that their job is to abide by our Constitution and stand up for Americans, not bow down to the woke mob.
If the Supreme Court won’t do their job to protect the Constitution, Congress must. Now, it’s more important than ever for the U.S. Senate to pass the SAVE America Act to prevent illegals from voting in our elections. This should be common sense. The sad reality is that it’s easier said than done. With a Republican majority in both the House and Senate and President Trump in the White House, this should be the easiest 1st and goal you’ve ever seen.
But for months, the Senate has been twiddling our thumbs, unwilling to pass the SAVE America Act. Republican Majority Leader John Thune claims it’s a math problem. In reality, the Uniparty is too concerned with protecting its own power to blow up the filibuster and get this done. Enough is enough. It’s time to get off our butts and actually do something for the American people.
Like it or not, this Supreme Court decision will change the United States, and it’s up to Republicans in the House and Senate to save it. In a few days, we’ll celebrate our country’s 250th birthday. Now’s our chance to pass legislation that will preserve our country for generations to come.
Are we going to seize the opportunity?
Or are we going to continue to go along to get along? The American people’s mandate to Congress and the Trump administration is simple: secure our elections, deport all the illegal aliens in our country, and put American citizens first.
U.S. Senator Tommy Tuberville represents Alabama in the United States Senate and is a member of the Senate Armed Services, Agriculture, Veterans’ Affairs, HELP and Aging Committees. He is also a candidate for Governor of Alabama in 2026.
