Earlier this week, AL(dot)com’s Kyle Whitmire took exception to State Sen. Arthur Orr’s (R-Decatur) suggestion that a Birmingham-Southern College $500 fee on the unvaccinated could be a “constructive denial” and a possible violation of state law, passed by the legislature and signed into law by Gov. Kay Ivey earlier this year.
In a column, Whitmire called Orr’s “constructive denial” claim “constructive reasoning” and speculated that Orr had not read the vaccine passport legislation he sponsored and shepherded through the Alabama Legislature.
During his weekly appearance on Huntsville radio WVNN’s “The Dale Jackson Show,” Orr responded to Whitmire.
Orr claimed Whitmire had called him to comment on his bill at an inopportune time, which was while driving in traffic in Atlanta, and refused to allow him to call back while referencing the legislation during his questioning. For that reason, Orr claimed Whitmire was “not an honest broker.”
“Here’s the net of all of this, Dale — he’s not an honest broker,” Orr said. “I mean, you look at the article — Steve Marshall came out with a second round of guidance, particularly referencing not by name but the Birmingham-Southern situation. That’s completely ignored, and Steve Marshall says you [can’t] charge kids a $500 fee — that’s a constructive denial based on their vaccination status. So, you know again, he gets to control the whole narrative.”
“I did not call him back this last time because I’ve found you don’t get a fair shake,” he continued. “He’s already written his article. He’s just looking for a quote to take out of context or whatever he wants to do to help him justify where he is going.”
