UA, Auburn issue joint cease and desist to UAW over trademark infringement

The University of Alabama and Auburn University have issued a rare joint statement over the misuse of their registered trademarks. The United Auto Workers (UAW) received cease and desist letters from attorneys representing both universities for mass producing and distributing pro-union merchandise featuring official university trademarks ahead of next week’s vote at the Mercedes-Benz plant near Tuscaloosa.

“The United Auto Workers are currently infringing on the intellectual property rights of The University of Alabama and Auburn University by using our trademarks without our endorsement or permission,” the joint statement from the University of Alabama and Auburn University reads.

“UAW has been explicitly instructed to stop improperly using our trademarks in their campaign (e.g., on their website, stickers, t-shirts, etc.). Both institutions will continue to take all necessary action to protect our intellectual property rights.”

Both schools said the goal is to eliminate confusion about their support on a controversial political topic. 

According to Auburn’s official cease and desist letter, “UAW’s activity infringes the University’s trademark rights because it is likely to cause confusion as to whether UAW or its activities are affiliated, connected, or associated with the University.”

“Additionally, the University reaffirms its historical commitment to remain neutral on all political matters and does not endorse or support any political candidate, campaign, or Organization,” the letter read. “Additionally, the University demands that all items depicting the AU Mark be provided to Auburn University to ensure they are no longer being distributed or used.”
