Steve Marshall files preliminary injunction against Biden administration’s Title IX rule

Alabama Attorney General Steve Marshall is pursuing all legal avenues available to combat what conservative officials in all states are calling a “radical” change to Title IX by President Joe Biden’s administration. Marshall announced he filed for a preliminary injunction on Wednesday.

The change, which took effect on Aug. 1, expands the reach of Title IX. Originally established in 1972, the law banned sex discrimination in educational programs that received federal funding. Biden’s version bans discrimination and harassment based upon sexual orientation and gender identity. It also expands the scope of sexual harassment complaints that schools will have to investigate.

“Following our lawsuit against the Biden Administration last week, today, we have taken the additional step of asking the court to immediately halt the new Title IX rule,” Marshall said. “I will not allow Alabama’s schools to be hijacked by this Administration and its radical gender ideology.”

“Our schoolchildren are worth the fight.”

In an April joint statement, Marshall and State School Superintendent Eric Mackey also told Alabamians that the new rule would not be adhered to.

“Title IX, as passed by Congress in 1972, prohibits sex-based discrimination in any education program or activity that receives federal funding. The new rule seeks to expand the meaning of “sex” to include sexual orientation and gender identity. Compliance with the rule may run afoul of relevant state law.”

“Please be advised that no public school district in the State of Alabama should take any step to implement the new Title IX rule at this time.”

Marshall has assured the citizens of Alabama that Biden will not be successful in his attempts to corrupt Title IX.

“Since taking office, Joe Biden has brazenly attempted to use federal funding to force radical gender ideology onto states that reject it at the ballot box,” Marshall said. “Now our schoolchildren are the target. The threat is that if Alabama’s public schools and universities do not conform, then the federal government will take away our funding.”

“Rest assured, Biden will not be successful.”
