A judge has scheduled an immunity hearing next month for a Montgomery police officer charged with murder in a 2016 shooting death.
Circuit Judge Greg Griffin this week scheduled a July 26 hearing on the immunity request.Lawyers for Aaron Smith maintain that Smith was acting in his official capacity, was justified in the shooting and should be immune from prosecution in the shooting of 58-year-old Greg Gunn.
Smith is charged in the 2016 shooting death of Gunn during a confrontation that began when Smith stopped Gunn as he was walking in his neighborhood.
The case is scheduled to go to trial on Aug. 13.
