In a 5-4 decision announced Thursday, the U.S. Supreme Court sided with the Biden administration in allowing for the termination of “Remain in Mexico.”
The Trump-era border policy, officially known as Migrant Protection Protocols, mandated foreign nationals seeking entry into the United States to remain in their countries of origin while their cases were processed.
Chief Justice John Roberts wrote in the majority opinion that the administration held the legal authority to terminate the policy and advised that the move would not conflict with existing federal statute.
Roberts was joined by Justice Brett Kavanaugh, along with liberal Justices Stephen Breyer, Sonia Sotomayor and Elena Kagan, in ruling in favor of the Biden administration.
In reaction to the ruling, Gov. Kay Ivey issued a statement Thursday morning asserting that the Biden administration’s halt of “Remain in Mexico” had served to inflame the border crisis.
“The Biden Administration’s decision to end President Trump’s Remain in Mexico policy is contributing to the full-blown crisis at the Southern Border and is having devastating effects on both U.S. citizens and migrants,” lamented Ivey. “This was reasonable, good policy, and ending this policy only exacerbates the problem, plain and simple. DHS does not have the capacity to detain the massive flow of individuals, and instead of choosing this clearly effective and legal option, they are releasing these people all across the country.”
Ivey, who is a member of the American Governors’ Border Strike Force, declared that Alabama would continue its efforts alongside other Republican-governed states to combat illegal immigration.
“Where the federal government has refused to secure the Southern Border, states like Texas, Alabama and our neighbors have stepped up to provide resources,” added the governor. “We will continue our fight to demand action from our government.”
In addition to signing legislation barring the Yellowhammer State from becoming a sanctuary for illegal aliens, Ivey in 2021 deployed Alabama National Guard Troops to the southern border to assist with federal operations.
