Byrne: ‘I don’t know’ we can end birthright citizenship by executive order — May require constitutional amendment

Tuesday during a debate broadcasted on Mobile’s FM Talk 106.5 with his Alabama first congressional district Democratic opponent Robert Kennedy, Jr., Rep. Bradley Byrne (R-Fairhope) expressed his skepticism of a proposal to end birthright citizenship by President Donald Trump made in an interview with Axios.

“It was always told to me that you needed a constitutional amendment. Guess what? You don’t,” Trump told Axios. He also said he had always been told birthright citizenship could be ended “with an Act of Congress, but it had later been determined he could do it “just with an executive order.”

Byrne questioned if it could be done with either an Act of Congress or an executive order, and said it probably does require a constitutional amendment.

“That first came about because of the 14th Amendment of the Constitution,” Byrne said to moderator and FM Talk 106.5 host Sean Sullivan. “And I don’t think the people that wrote the 14th Amendment of the Constitution intended for people to abuse it the way it’s being abused now. The fact that President Trump is trying to address it, and I applaud him for doing it – I don’t know that we can do it by an executive order. It may not be something we can do by statute. It may be that we’re going to have to amend the 14th Amendment.”

“But I applaud the president for taking the step that he’s taken,” he added. “Let’s see where it gets. If it turns out there’s a legal problem with it, then maybe we need to take a step back and look at something else.”
