Alabama Attorney General Steve Marshall on Wednesday announced that he, on behalf of the State of Alabama, has joined an amicus brief supporting the State of Texas in its lawsuit against the Commonwealth of Pennsylvania, State of Georgia, State of Michigan and State of Wisconsin.
The lawsuit, filed by Texas Attorney General Ken Paxton, is asking the Supreme Court of the United States to block the 2020 presidential election results in those swing states.
President Donald. J. Trump has indicated he will be intervening in the lawsuit, calling it “the big one.”
“These elections in other states where state law was not followed … affects my voters because these are national elections, and so if there are fraudulent things or things that affect an election and state law is not followed as is required by the Constitution it affects our state,” Paxton explained to Fox News Channel. “We can’t go back and fix it, but we can say, OK, let’s transfer this to the legislature … and let them to decide the outcome of the election. That would be a valid constitutional situation.”
In addition to Alabama, 16 other states have joined the amicus brief. This comes after Alabama PSC President Twinkle Andress Cavanaugh publicly encouraged Marshall to formally support Texas’ lawsuit.

The amicus brief outlines a few core arguments the respective States are making.
“First, the States have a strong interest in safeguarding the separation of powers among state actors in the regulation of Presidential elections,” the brief notes. “Second, amici States have a strong interest in ensuring that the votes of their own citizens are not diluted by the unconstitutional administration of elections in other States. … Third, for similar reasons, amici States have a strong interest in safeguarding against fraud in voting by mail during Presidential elections.”
Trump on Wednesday tweeted in part, “We will soon be learning about the word ‘courage’, and saving our Country.”
